Rule summary

Rules and effective period

For this standard full-payment case, paying by day 15 gives no late-payment penalty. Payment on days 16–30 attracts a first component on the day-15 outstanding balance. After day 30 another component is added on the day-30 balance; a second penalty accrues daily from day 31 through the payment day inclusive.

The higher rates are 3% at each first-penalty stage and 10% annually for the second penalty. HMRC CH193140 requires both a VAT period starting on/after 1 April 2025 and a due date on/after 31 May 2025. Otherwise the supported earlier rates are 2%, 2% and 4% annually. A payment made later does not itself move an older liability into the new regime.

Daily calculation uses the relevant unpaid balance × annual rate × days/365. Here there are no part-payments, so the supplied amount stays outstanding until full payment. Penalty components are shown separately. Late-payment interest is additional and excluded, including during the first 15 days.

A Time to Pay proposal accepted by HMRC can change the penalty position. Partial payments, credits, instalments, assessments, reasonable excuse and mitigation need separate review. Periods before January 2024 and delays longer than one year are outside this calculator; it does not model the 2023 familiarisation concession.

Worked examples

How the rule behaves in practice

  • HMRC's 51-day example: A qualifying higher-rate VAT liability of £15,000 is paid in full 51 days late, with no Time to Pay or part-payments. £450 at day 15 + £450 at day 30 + £15,000 × 10% × 21/365 (£86.30) = £986.30. Interest is excluded.
  • Older-period transition: The same £15,000 and 51-day delay relates to a VAT period beginning before 1 April 2025. The earlier regime applies: £300 + £300 + £34.52 = £634.52, even if payment is after the rate change.

Practical consequences

  • A calculator estimate is not an HMRC assessment. Confirm the recorded facts and seek professional review for excluded cases.
  • Filing and payment obligations are distinct; meeting one does not satisfy the other.

Important limits

  • An estimate under entered facts, not an HMRC assessment. Choose No / unsure for facts outside the supported case; professional review is required.
  • Appeals, reasonable excuse, disputed balances and specialist reliefs are not determined here.
